We strive for Preventative Counseling

In representing employers/management, Peterpaul Law counsels and defends employers and businesses in all industries and of all sizes with regard to all aspects of Labor & Employment Law.  Our primary focus in working with employers/management is to reduce the risk of claims and employment litigation by ensuring that our clients’ employment-related policies and practices are up to date and in compliance with state and federal law.  We conduct audits of human resources procedures, negotiate collective bargaining agreements, conduct workplace investigations, and draft employee handbooks, employment contracts, restrictive covenants/non-compete agreements and severance agreements. We also conduct anti-harassment training and counsel employers on issues such as handling requests for leave, and best practices for everything from hiring through termination.  Through such preventative counseling, Peterpaul Law can assist employers in significantly reducing the likelihood of expensive and protracted employment litigation. 

In the Event of Litigation

However, in the event of litigation, our employment-law attorneys aggressively defend employment-related claims in state and federal courts, before administrative agencies including the Equal Employment Opportunity Commission (EEOC) and the New Jersey Division on Civil Rights (DCR), and in arbitration proceedings. Our extensive litigation experience includes the defense of a wide variety of claims, including claims of discrimination, sexual and other types of harassment, unlawful retaliation, whistleblower, wrongful discharge, and wage and hour claims. We also frequently litigate issues relating to the enforceability of restrictive covenants, and non-compete and non-solicitation provisions.

Representing Employees

In representing employees, we fight for employees who are subjected to harassment and discrimination based on race, sex, pregnancy, national origin, sexual orientation, gender identity, disability, and religion. We also aggressively pursue whistleblower/retaliation and wage and hour claims on behalf of employees. We also defend employee’s rights pursuant to other state and federal employment-related statutes, such as the Law Against Discrimination (“LAD”), Title VII, FMLA, ADEA, ADA, CEPA, NJFLA, NJ SAFE Act, NJWCA, and the Equal Pay Act.
